Terms of Use

1. Eligibility and accounts

You must be legally able to enter this agreement. If you are a minor where you live, a parent or legal guardian must authorize your use. The Services are not directed to children under 13. You must provide accurate account information, protect your credentials, and promptly tell us about unauthorized access. You are responsible for activity through your account.

2. The Services and AI output

ReCrea provides tools for AI-assisted photo and video generation, personalized avatar or model training, image editing, creative prompts, and the Emma assistant. AI output is generated probabilistically. It may be inaccurate, unexpected, similar to output created for another user, or unsuitable for your intended use. You must review output before relying on, publishing, or commercially using it.

3. Third-party AI processing and permission

The app asks English-language users for permission before their first AI request and blocks the request if permission is not given. When you tap Agree & Continue, you instruct and authorize ReCrea to send the disclosed data to those providers for your current request and future use of the described AI features.

You can withdraw permission in Profile → Settings & Actions → AI data sharing. We will ask again if the data, providers, or purposes materially change. Full provider-by-provider details are in the Privacy Policy.

4. Your content and required permissions

You retain your rights in photos, videos, prompts, chat messages, and other content you submit ("User Content"). You grant ReCrea a limited, non-exclusive, worldwide license to host, copy, transmit, process, modify, and display User Content only as needed to operate, secure, support, and improve the Services, fulfill your requests, and comply with law.

You represent that you have all rights and permissions needed for every person, face, voice, location, trademark, and other protected material in your User Content. You must not upload a person's photo or personal data without authority to do so. You are responsible for your use and distribution of AI output.

5. Prohibited use and child protection

You may not use the Services to violate law or another person's rights; impersonate or deceive; create non-consensual intimate imagery; facilitate abuse, exploitation, harassment, fraud, or violence; bypass safety controls; introduce malware; overload or reverse engineer the Services; or access another account without authorization.

ReCrea strictly prohibits content that sexualizes, exploits, or depicts sexual conduct involving anyone under 18, whether real, edited, or AI-generated. We may block content, suspend or terminate accounts, preserve evidence, and report conduct where legally required.

6. Moderation and enforcement

We may use automated and human review to detect prohibited, illegal, unsafe, or abusive activity. We may refuse a request, remove content, limit a feature, suspend or terminate an account, or cooperate with authorities when reasonably necessary to enforce these Terms, protect safety, or comply with law.

7. Purchases, subscriptions, tokens, and refunds

Paid features may be sold as subscriptions, packages, or consumable tokens. Prices, billing periods, included benefits, and renewal terms are displayed before purchase. App-store purchases are also governed by the applicable store's terms. Taxes and currency conversion may apply.

Subscription consent and token refunds

By confirming a recurring subscription, you authorize the applicable app store or payment processor to charge the displayed amount at each renewal until cancellation. Manage or cancel an app-store subscription through that store. Cancellation stops future renewal but does not normally refund a completed billing period.

Tokens are consumed when a generation or other paid action is accepted for processing. Failed actions may be restored automatically or after investigation. Except where law or store rules require otherwise, used tokens and successfully delivered digital services are non-refundable. Send billing disputes to support with your account ID and transaction details.

8. Intellectual property

ReCrea and its licensors own the Services, software, branding, interfaces, models, and other materials we provide, excluding User Content. We grant you a limited, personal, revocable, non-transferable license to use the Services under these Terms. No license is granted to copy, sell, sublicense, scrape, reverse engineer, or exploit the Services themselves.

9. Availability and changes

AI models, providers, prices, features, output quality, and availability can change. We may modify or discontinue features, impose reasonable limits, or perform maintenance. If a material AI data-sharing change affects previously granted consent, we will request permission again before the new processing.

10. Disclaimers and limitation of liability

To the fullest extent allowed by law, the Services and AI output are provided "as is" and "as available" without warranties of accuracy, uninterrupted availability, merchantability, fitness for a particular purpose, or non-infringement. ReCrea is not responsible for decisions you make based on AI output or for unauthorized content you submit.

Nothing in these Terms excludes rights or liability that applicable law does not permit us to exclude. Otherwise, ReCrea will not be liable for indirect, incidental, special, consequential, or punitive damages, loss of profits, data, goodwill, or business opportunity arising from the Services.

11. Termination and deletion

You may stop using the Services or delete your account from Profile. We may suspend or terminate access for a material or repeated violation, legal requirement, safety risk, fraud, or non-payment. Provisions that by their nature should survive termination remain effective, including ownership, payment obligations, disclaimers, and limitations.

12. Apple App Store terms

If you downloaded the app from Apple, these Terms are between you and ReCrea, not Apple. Apple has no obligation to provide maintenance or support and is not responsible for the app or related claims except as required by its store terms. Apple and its subsidiaries are third-party beneficiaries of this section.

13. Changes and contact

We may update these Terms and will post the updated date. We will provide additional notice where required. If you do not agree to an update, stop using the Services before it takes effect.
